BAKER, et al., 15 Defendants. 16 17 Plaintiff, a state prisoner proceeding through counsel, has filed a motion to compel non- 18 party California State Prison (CSP)-Sacramento to comply with a subpoena duces tecum. ECF 19 No. 95. Plaintiff and CSP-Sacramento have filed a joint statement in compliance with Local Rule 20 251(c). ECF No. 98. 21 I. Plaintiff’s Allegations 22 The complaint alleges that on November 4, 2015, plaintiff was in the yard of Facility C at 23 CSP-Sacramento and was stabbed approximately twenty-five times by two other inmates. ECF 24 No. 1 at 5. He alleges that none of the defendants made any attempt to intervene or stop the 25 assault while it was happening, and no response occurred until it was time for yard recall, which 26 was approximately four minutes after the attack ended.
