16 17 Petitioner Santosh Ram is proceeding pro se with a petition for writ of habeas corpus 18 pursuant to 28 U.S.C. § 2241. 19 I. 20 BACKGROUND 21 On October 14, 2021, Petitioner filed a federal petition for writ of habeas corpus 22 challenging a prison disciplinary proceeding on various due process grounds. (ECF No. 1). At 23 the time the petition was filed, Petitioner was in the custody of the Federal Bureau of Prisons 24 (“BOP”) at the Federal Correctional Institution in Mendota, California. (Id. at 1.)1 25 On January 20, 2022, Respondent filed a motion to dismiss the petition for nonexhaustion 26 in addition to arguing that the petition should be denied on the merits. (ECF No. 11.)
