15 16 I. BACKGROUND 17 Emanuel Boone (“Plaintiff”) is a state prisoner proceeding pro se and in forma pauperis 18 with this civil rights action filed pursuant to 42 U.S.C. § 1983. Plaintiff filed the Complaint 19 commencing this action on September 6, 2019. (ECF No. 1.) This case now proceeds with the 20 First Amended Complaint filed on October 5, 2020, against defendants Burnes, Tapia, Flores, 21 Brandon, Dowdy, Blanco, and Vega for use of excessive force in violation of the Eighth 22 Amendment. (ECF No. 13.) 23 On April 18, 2022, the court issued a Discovery and Scheduling Order setting out pretrial 24 deadlines for the parties (ECF No. 32), and on July 8, 2022, the court issued an Amended 25 Discovery and Scheduling Order, (ECF No. 39).
