17 Lawrence Christopher Smith is a state prisoner, who proceeded pro se and in forma pauperis 18 with this civil rights action filed pursuant to 42 U.S.C. § 1983. On September 2, 2022, the Court 19 determined Plaintiff failed to exhaust his administrative remedies and the action was barred by Heck v. 20 Humphrey. (Doc. 69.) The Court adopted the Findings and Recommendations, granted the 21 defendants’ motion for summary judgment without prejudice to Plaintiff filing a petition for writ of 22 habeas corpus, and directed the clerk to entry judgment in favor of the defendants.
