The undersigned granted plaintiff’s IFP application, screened the complaint, 21 and recommended dismissal of the federal claims with prejudice and dismissal of any potential 22 state law claims without prejudice. (ECF No. 3.) Plaintiff filed a first amended complaint 23 (“1AC”) within 21 days, which is allowed as a matter of right. Fed. R. Civ. P 15(a).
