FINDINGS AND RECOMMENDATIONS 14 MICHAEL PIKE, et al., 15 Defendants. 16 17 Plaintiff is a prisoner, proceeding pro se. Plaintiff seeks relief pursuant to 42 U.S.C. 18 § 1983. Plaintiff’s complaint raises alleged Eighth Amendment violations by defendants at Mule 19 Creek State Prison (“MCSP”), related to three incidents of sexual assault committed by multiple 20 inmates, all of which took place in December of 2020 and early 2021.1 (ECF No. 1.) Plaintiff’s 21 motion for temporary restraining order or preliminary injunctive relief is before the court. (ECF 22 No. 3.)
