21 22 I. BACKGROUND 23 Cory James White (“Plaintiff”) is a state prisoner proceeding pro se and in forma pauperis 24 with this civil rights action pursuant to 42 U.S.C. § 1983. Plaintiff filed the Complaint 25 commencing this action on June 29, 2020. (ECF No. 1.) On September 16, 2021, the Court 26 dismissed the Complaint for failure to state a claim, with leave to amend. (ECF No. 15.) On 27 October 12, 2021, Plaintiff filed the First Amended Complaint, which is now before the court for 28 screening. (ECF No. 16.) 28 U.S.C. § 1915. 1 II.
