No. 10) 16 17 Plaintiff Paul Edward Duran is a state prisoner proceeding pro se in this civil rights action 18 filed under 42 U.S.C. § 1983. Plaintiff’s First Amended Complaint is before the Court for 19 screening. (Doc. No. 10). For the reasons stated herein, the undersigned recommends the district 20 court dismiss the First Amended Complaint for failure to state a claim. 21 I. BACKGROUND 22 A. Procedural Posture 23 Plaintiff Duran commenced this action as a prisoner incarcerated within the California 24 Department of Corrections and Rehabilitation (CDCR) at Corcoran State Prison by filing a civil 25 rights complaint.
