15 Defendants. 16 17 Plaintiff is a state prisoner proceeding without counsel in this action brought under 18 42 U.S.C. § 1983. I previously screened plaintiff’s first amended complaint and found that it 19 stated an Eighth Amendment claim for sexual assault against defendant Cassie. ECF No. 15. 20 Before defendant filed a response to the complaint, plaintiff filed a motion to amend the 21 complaint. ECF No. 26. 22 The Federal Rules of Civil Procedure permit plaintiff to amend his complaint as a matter 23 of course before service of a responsive pleading. See Fed. R. Civ. P. 15(a). Accordingly, his 24 motion to amend is granted. He must file his amended complaint within thirty days of this 25 order’s entry.
