The matter was referred to a United States magistrate judge pursuant to 28 17 U.S.C. § 636(b)(1)(B) and Local Rule 302. 18 On September 27, 2022, the assigned Magistrate Judge entered Findings and 19 Recommendations (“F&R”), recommending that “[t]his case be dismissed, without prejudice, 20 because of Plaintiff’s failure to comply with a court order and to prosecute this case,” and that 21 “[t]he Clerk of Court be directed to close this case.” (Doc.
