17 18 By order filed November 2, 2022, plaintiff’s complaint was dismissed and thirty days 19 leave to file an amended complaint was granted. (ECF No. 6.) Thirty days from that date passed, 20 and plaintiff did not file an amended complaint. Accordingly, the undersigned recommends that 21 this action be dismissed. 22 On November 4, 2022, plaintiff filed a motion to stay this action. (ECF No. 9.) Plaintiff 23 alleges that he will be released from prison custody on November 14, 2022. (Id.) Plaintiff 24 alleges that he will be temporarily homeless upon his release. (Id.) Plaintiff requests that this 25 action be stayed until he obtains a mailing address. (Id.) 26 Records from the California Department of Corrections and Rehabilitation (“CDCR”) 27 indicate that plaintiff was not released from…
