(See generally, ECF No. 1, Complaint.) Defendant, Darren 19 Cobrae, proceeds pro se. (See generally, ECF No. 13, Late Answer.) This matter was referred to 20 the undersigned by Local Rule 302(c)(21) pursuant to 28 U.S.C. § 636(b)(1). 21 Plaintiff’s response to an order to show cause regarding subject matter jurisdiction is 22 before the court. (ECF No. 23.) Plaintiff has also filed an administrative motion for discovery 23 seeking to take the deposition of a third-party witness and an ex parte motion to strike defendant’s 24 recent filing as an untimely opposition and for a claimed defect in the proof of service.
