14 15 Defendants Panama-Buena Vista Union School District (“PBVUSD”) and Panama-Buena 16 Vista Union School District Board of Education (“PBVUSD Board”) bring a motion to dismiss 17 under Rule 12(b)(1) of the Federal Rules of Civil Procedure and, in the alternative, a motion for 18 judgment on the pleadings under Rule 12(c).1 Doc. No. 8. For the reasons that follow, the motion 19 to dismiss will be granted. 20 BACKGROUND 21 A. Summary of Relevant Allegations in the Complaint 22 Defendant PBVUSD is a public elementary school district that includes parts of Kern 23 County. Doc. No. 1 ¶ 10.
