Respondent has filed a motion to dismiss. 19 Petitioner is serving a sentence of 31-years-to-life following convictions in the 20 Sacramento County Superior Court for robbery and attempted robbery. ECF No. 14-1 at 2-3. On 21 direct appeal, counsel for petitioner filed a brief pursuant to People v. Wende, 25 Cal.3d 436 (Cal. 22 1979) asking the Third Appellate District to review the record and determine whether there were 23 any arguable issues. Id. at 1. Finding “no arguable error that would result in a disposition more 24 favorable to defendant” the Third Appellate District affirmed petitioner’s convictions and 25 sentences on April 23, 2021.
