(Docs. 32, 24) 16 17 The assigned magistrate judge issued findings and recommendations to deny Plaintiff’s 18 motion for a temporary restraining order and preliminary injunction. (Doc. 32). The Court found 19 that, without an operative complaint and service on any defendant, there was no case or 20 controversy before the Court, and Plaintiff had not established subject matter jurisdiction over 21 the claims or personal jurisdiction over any defendant. Additionally, the Court determined that 22 Plaintiff is unable to satisfy the factors for the issuance of a preliminary injunction, including a 23 likelihood of success on the merits, under Winter v.
