SERRANO, 15 Defendant. 16 17 Plaintiff Yakini Deandre Byrd (“Plaintiff”) initiated this action proceeding pro se by filing 18 a prisoner civil rights compliant under 42 U.S.C. § 1983. (ECF No. 1.) The matter was referred 19 to the assigned United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local 20 Rule 302. 21 On October 19, 2022, the assigned Magistrate Judge issued a findings and 22 recommendations, recommending the Court deny Plaintiff’s motion for summary judgment and 23 grant Defendant’s cross-motion for summary judgment. (ECF No. 76.) The findings and 24 recommendations were served on the parties and contained notice that any objections thereto 25 must be filed within fourteen (14) days. (Id. at 1, 24.)
