Peña, requests attorney fees and expenses in the amount of $7,697.04, pursuant to the Equal Access to Justice Act (“EAJA”), 28 U.S.C. § 2412. (Id.). The Commissioner has not responded to Plaintiff’s motion, and the deadline for doing so has passed. For the reasons set forth more fully below, the undersigned recommends the district court grant Plaintiff’s motion for EAJA attorney fees.
