FINDINGS AND RECOMMENDATIONS 14 MARCH FONG EU, et al., 15 Defendants. 16 17 Plaintiff, a prisoner proceeding pro se, brings this civil rights action pursuant to 18 42 U.S.C. § 1983. 19 On September 21, 2021, the Court concluded that Plaintiff’s original complaint 20 failed to state a claim against the named Defendants and provided Plaintiff an opportunity to file a 21 first amended complaint. See ECF No. 10. Plaintiff thereafter filed a first amended complaint. 22 See ECF No. 11. Plaintiff then filed a second amended complaint as of right pursuant to Federal 23 Rule of Civil Procedure 15, which is now before the Court. See ECF No. 12. 24 The Court is required to screen complaints brought by prisoners seeking relief 25 against a governmental entity or officer or employee of a governmental entity.
