17 18 Plaintiff filed a pro se complaint, and then a first amended complaint, seeking relief under 19 42 U.S.C. § 1983. This matter was referred to the undersigned by Local Rule 302(c)(21) pursuant 20 to 28 U.S.C. § 636(b). 21 By order signed and filed on October 24, 2022 (ECF No. 5), the undersigned screened the 22 first amended complaint pursuant to 28 U.S.C. § 1915(e), advised plaintiff of the deficiencies in 23 the first amended complaint, and granted plaintiff thirty days to file a further amended complaint. 24 Plaintiff was warned that failure to file a further amended complaint would result in a 25 recommendation that this action be dismissed.
