19 20 I. BACKGROUND 21 Fernando Coria, Jr. (“Plaintiff”) is a state prisoner proceeding pro se and in forma 22 pauperis with this civil rights action filed pursuant to 42 U.S.C. § 1983. This case now proceeds 23 with Plaintiff’s original Complaint filed on November 20, 2020, against defendants Garcia, 24 Navarro, Gallaway, and Avila-Becerra (“Defendants”) for use of excessive force in violation of 25 the Eighth Amendment.
