(Doc. 16) Defendant. 16 I. Background Plaintiff Fernando Gastelum (“Plaintiff”), proceeding pro se, filed the instant action on June 27, 2022. (Doc. 1.) Defendant Petco Animal Supplies Stores, Inc. (“Defendant”) filed a motion to dismiss Plaintiff’s complaint pursuant to Federal Rule of Civil Procedure 12(b)(1) on September 12, 2022.1 (Doc. 5.) In lieu of a response, Plaintiff filed a first amended complaint. (Doc. 12.) Based on the filing of the first amended complaint, the Court denied Defendant’s motion to dismiss as moot and permitted Defendant to file a renewed motion to dismiss Plaintiff’s first amended complaint.
