16 I. RELEVANT BACKGROUND On January 9, 2023, Plaintiff filed a document titled “Plaintiff’s Request for Judicial Notice in Support of Application for Appointment of Counsel.” (Doc. 34.) Plaintiff notes this filing was “filed concurrently herewith: (1) Plaintiff’s Application for Appointment of Counsel; and (2) Plaintiff’s Application for 90-day Extension to File Opposition to Defendants’ Motion to Dismiss.” (Id.) The Court granted Plaintiff’s request for a 90-day extension of time within which to file an opposition to the pending motion to dismiss (see Doc. 35) in an Order issued January 11, 2023. (Doc. 36.)
