19 Plaintiff Esmeling L. Bahena (“Plaintiff”) is a state prisoner proceeding pro se and in 20 forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. Plaintiff initiated this 21 action on June 10, 2022 in the Sacramento Division of the United States District Court of the Eastern District of California. (ECF No. 1.) The action was transferred to the Fresno Division on December 12, 2022. (ECF No. 14.) Plaintiff moved for leave to file a first amended complaint and leave was granted.
