The matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. Plaintiff’s second amended complaint (“SAC”), ECF No. 31, is now before the court for screening. This is the third complaint to have been screened in this case. See ECF Nos. 1, 16 (original complaint and first screening); 20, 28 (first amended complaint and second screening); 31 (second amended complaint). For the reasons stated below, the undersigned will recommend that this action be dismissed for failure to state a claim upon which relief may be granted. I.
