16 Before the Court is Plaintiff’s Complaint. (Doc. No. 1). For the reasons set forth below, the undersigned recommends the district court dismiss the Complaint under § 1915A for failure to state a claim. BACKGROUND AND SUMMARY OF OPERATIVE PLEADING A. Procedural History Plaintiff, a state prisoner proceeding pro se, initiated this action by filing a civil rights complaint under 42 U.S.C. § 1983. (Doc. No. 1). He also simultaneously filed a Motion for Preliminary Injunction. (Doc. No. 2). The District Judge denied Plaintiff’s Motion for Preliminary Injunction. (Doc. No. 13).
