STANE, et al., Defendants. 16 Plaintiff Rogelio May Ruiz initiated this action as a prisoner proceeding pro se by filing a civil rights complaint under 42 U.S.C. § 1983 on February 22, 2022. (ECF No. 1). The matter was referred to the assigned United States magistrate judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. On July 15, 2022, the Magistrate Judge issued findings and recommendations recommending Plaintiff’s motion to proceed in forma pauperis be denied because Plaintiff qualifies as a three-striker under 28 U.S.C. § 1915(g) and does not meet the imminent danger exception. (ECF No. 23 at 5–7). Further, the Magistrate Judge recommended dismissal due to Plaintiff’s failure to prosecute his case in compliance with court order. (Id. at 7).
