16 (ECF No. 49.) 17 I. BACKGROUND Kevin Allen (“Plaintiff”) is a state prisoner proceeding pro se and in forma pauperis with this civil rights action pursuant to 42 U.S.C. § 1983. On November 25, 2020, this case was dismissed, with prejudice, for failure to state a claim. (ECF No. 37.) On December 22, 2020, Plaintiff filed an appeal to the Ninth Circuit Court of Appeals. (ECF No. 39.) On March 3, 2023, the Ninth Circuit affirmed in part and reversed in part the district court’s decision to dismiss the case and remanded the case to the district court, where the case was reopened.
