On March 25, 2022, this matter was referred to the undersigned for all further proceedings and entry of final judgment based on the consent of all the parties. ECF No. 25. On February 17, 2023, defendant filed a motion for summary judgment. ECF No. 32. On March 1, 2023 plaintiff was granted an extension of time to file an opposition until May 30, 2023. ECF No. 36. In the same order, plaintiff was informed that failure to file an opposition would result in a recommendation that this action be dismissed pursuant to Fed. R. Civ. P. 41(b).
