17 This matter is before the Court on Defendant Sheriff Wendell Anderson’s (“Defendant”) motion to dismiss (ECF No. 12). Plaintiffs Estate of William Hennefer, JAH, JUH, WH, NH, and Bianca Hennefer (together “Plaintiffs”) filed an opposition. (ECF No. 16.) Defendant filed a reply. (ECF No. 18.) Factual Background On January 25, 2021, Deputy Tyler Eck (“Deputy Eck") of the Yuba County Sheriff’s Department (“YCSD”) responded to a call from concerned property owners outside of Marysville, California.
