12 Defendant. 13 14 Plaintiff James Grzelso is a state prisoner proceeding pro se and in forma pauperis in this 15 civil rights action pursuant to 42 U.S.C. § 1983. This case proceeds on Plaintiff’s First 16 Amendment claim against Defendant Suazo. 17 On April 13, 2023, this Court entered an order requiring the parties to file statements 18 regarding scheduling and discovery within 30 days from the date of service of the order. (ECF 19 No. 57). Upon Plaintiff’s request, the Court extended the deadline for him to file his statement to 20 June 19, 2023. (ECF No. 59). However, Plaintiff still has not filed his statement. 21 The Court recognizes that Plaintiff has filed a petition for writ of mandamus in the Ninth Circuit. (ECF No. 61).
