17 18 On May 30, 2023, the Magistrate Judge filed findings and recommendations 19 herein which were served on Plaintiff and which contained notice that any objections 20 to the findings and recommendations were to be filed within fourteen days. No 21 objections were filed. 22 The Court presumes that any findings of fact are correct. See Orand v. United 23 States, 602 F.2d 207, 208 (9th Cir. 1979). The magistrate judge’s conclusions of law 24 are reviewed de novo. See Britt v. Simi Valley Unified School Dist., 708 F.2d 452, 454 25 (9th Cir. 1983). 26 Although it appears from the file that Plaintiff’s copy of the findings and 27 recommendations was returned, Plaintiff was properly served. It is the Plaintiff’s 28 responsibility to keep the Court apprised of his current address at all times. Pursuant 1 | to Local Rule 182(f), service of documents at the record address of the party is fully 2 | effective. 3 The Court has reviewed the applicable legal standards and, good cause 4 | appearing, concludes that it is appropriate to adopt the Proposed Findings and 5 | Recommendations in full. 6 Accordingly, IT IS ORDERED that: 7 1. The Proposed Findings and Recommendations filed May 30, 2023, are 8 ADOPTED; 9 2. Plaintiff's claims are DISMISSED without prejudice under Local Rule 183(b); 10 and 11 3.
