17 Plaintiff Clarence L. Hearns is proceeding pro se and in forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. I. PROCEDURAL BACKGROUND Plaintiff initiated this action with the filing of his original complaint on August 16, 2022. (Doc. 1.) That same date, Plaintiff filed a motion for injunctive relief. (Doc. 3.) On October 13, 2022, the Court issued Findings and Recommendations to Deny Motion for Preliminary Injunction and Temporary Restraining Order. (Doc. 13.) Plaintiff filed his objections on November 3, 2022. (Doc. 16.) On November 8, 2022, District Judge Jennifer L.
