Plaintiffs raise a number of claims pursuant to 42 U.S.C. § 1983 and California state law based on their arrest and the investigation that preceded it. Presently before the Court is Defendants’ motion to dismiss some of the claims raised in the Third Amended Complaint. (Defs.’ Mot. (ECF No. 115).) For the reasons stated below, Defendants’ Motion to Dismiss is GRANTED IN PART and DENIED IN PART. I. Background Plaintiffs are the wife and daughter of criminal defense attorney Frank Carson.
