This proceeding was 17 referred to this court by Local Rule 302(c)(21). 18 On July 21, 2023, the undersigned dismissed the complaint in this action with leave to file 19 an amended complaint within 28 days. (ECF No. 3.) Plaintiff was informed that failure to file an 20 amended complaint could result in the dismissal of this action. The deadline has passed, and 21 plaintiff has not filed an amended complaint nor otherwise responded to the court’s order. 22 Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed for lack of 23 jurisdiction. 24 In light of these recommendations, IT IS ALSO HEREBY ORDERED that all pleading, 25 discovery, and motion practice in this action are STAYED pending resolution of the findings and 26 recommendations.
