17 This matter is before the court on the motion to dismiss plaintiffs’ second amended complaint filed by defendants pursuant to Federal Rule of Civil Procedure 12(b)(6) on June 25, 2021. (Doc. No. 18.) On August 5, 2021, the court vacated the hearing on the pending motion in light of the referral of this case to the court’s Voluntary Dispute Resolution Program, and on September 14, 2022, the parties notified the court that they were unable to settle this case.
