(ECF No. 25.) Defendant Paul Betenbaugh (“Defendant”) filed an opposition. (ECF No. 32.) Plaintiff filed a reply. (ECF No. 38.) Also before the Court is Defendant’s Motion to Amend the Answer. (ECF No. 22.) Plaintiff filed an opposition. (ECF No. 27.) Defendant did not file a reply. For the reasons set forth below the Court GRANTS in part and DENIES in part Plaintiff’s motion for summary judgment and DENIES Defendant’s motion to amend his answer. 24 The only other Defendant in this action, Dalas Gundersen, did not file an opposition.
