The motion was set for hearing on the papers on November 15, 2023. ECF No. 23. Defendant has not responded to the motion or participated in this case in any way. For the reasons set forth below, the court recommends plaintiffs’ motion be GRANTED, and that judgment be entered in favor of plaintiffs. I.
