17 Plaintiff is proceeding pro se and in forma pauperis in this action filed pursuant to 42 18 U.S.C. § 1983. Plaintiff filed the instant action on July 21, 2023. 19 On August 11, 2023, the Court screened Plaintiff’s complaint, found no cognizable claim, 20 and granted Plaintiff thirty days to file an amended complaint. (ECF No. 9.) Plaintiff failed to 21 file an amended complaint or otherwise respond to the Court’s order. Therefore, on September 22 20, 2023, the Court ordered Plaintiff to show cause why the action should not be dismissed. 23 (ECF No. 10.) Plaintiff filed a response on October 3, 2023. (ECF No. 11.)
