On May 27, 2021, a scheduling order issued (ECF No. 15), which has been modified four times by stipulation of the parties: on June 6, 2022, October 21, 2022, January 19, 2023, and August 7, 2023. (ECF Nos. 23, 25, 29, 32.) Relevant to the instant motion, the expert discovery deadline expired on October 20, 2023, the pretrial conference is set for December 18, 2023, and trial is set for February 27, 2024.
