Pending before the undersigned are defendants’ motions to dismiss, as well as plaintiff’s motions to dismiss. (ECF Nos. 9, 28, 40 & 45.) Having considered the parties’ briefing, and for the reasons stated below, the undersigned recommends that defendants’ motions to dismiss be granted, plaintiff’s motions to dismiss be denied, and this action be closed.
