This matter was referred to the undersigned in accordance with Local Rule 302(c)(21) and 28 U.S.C. § 636(b)(1). Pending before the undersigned are defendants’ motions to dismiss pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure, plaintiff’s motion for summary judgment, and defendant Kyle Wilcox’s motion for an extension of time to respond to plaintiff’s motion for summary judgment. (ECF Nos. 16, 18, 23, 25.) For the reasons stated below, defendants’ motions to dismiss will be granted, plaintiff will be granted leave to file an amended complaint, and plaintiff’s motion for summary judgment and defendant’s motion for an extension of time will be denied.
