FINDINGS AND RECOMMENDATIONS 14 BRAZIL, et al., 15 Defendants. 16 17 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 18 U.S.C. § 1983. On July 28, 2023, defendants filed a motion to compel further responses to 19 requests for discovery. ECF No. 29. On October 24, 2023, plaintiff was ordered to file a response 20 to the motion within thirty days. ECF No. 38. In the same order, plaintiff was informed that 21 failure to file a response would result in a recommendation that this action be dismissed pursuant 22 to Fed. R. Civ. P. 41(b). The thirty day period has now expired, and plaintiff has not responded to 23 the court’s order.
