BALAJI, et al., 15 Defendants. 16 17 Petitioner is a federal prisoner pursuing a civil rights action under 48 U.S.C. § 1983. ECF 18 No. 1. On February 28, 2023, defendants filed a motion for summary judgment. ECF No. 68. 19 On August 2, 2023, the court granted plaintiff additional time for discovery and to oppose the 20 summary judgment motion. The court ordered plaintiff to file an opposition to the motion by 21 October 30, 2023. ECF No. 83. Plaintiff failed to do so, and on November 20, 2023, the court 22 ordered him to file either an opposition or a statement of no opposition to the summary judgment 23 motion within thirty days. ECF No. 89. In the same order, plaintiff was informed that failure to 24 file an opposition would result in a recommendation that this action be dismissed pursuant to Fed. 25 R. Civ.
