17 18 This matter is before the court on defendant’s motion to compel arbitration. (Doc. No. 19 46.) On September 27, 2023, the pending motion was taken under submission on the papers 20 pursuant to Local Rule 230(g) after it was reassigned to the undersigned. (Doc. Nos. 50, 53.) For 21 the reasons explained below, the court will grant defendant’s motion to compel arbitration. 22 BACKGROUND 23 On September 21, 2022, plaintiff Rick D.
