MUELLER, et al., 15 Defendants. 16 17 Plaintiff, a state prisoner proceeding pro se, filed this civil rights action seeking relief 18 under 42 U.S.C. § 1983. The matter was referred to a United States Magistrate Judge pursuant to 19 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 20 On January 2, 2024, the magistrate judge filed findings and recommendations. Good 21 cause appearing, the findings and recommendations are vacated.1 22 Plaintiff requests leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. 23 Plaintiff submitted a declaration that makes the showing required by 28 U.S.C. § 1915(a). 24 Accordingly, the request to proceed in forma pauperis is granted. 25 Plaintiff is required to pay the statutory filing fee of $350.00 for this action. 28 U.S.C. 26 §§ 1914(a), 1915(b)(1).
