17 18 This matter is before the court on defendants Topgolf Payroll Services, LLC; Topgolf 19 International, Inc.; and Topgolf USA Roseville, LLC’s July 25, 2023 motion to dismiss certain of 20 plaintiff’s claims asserted in his second amended complaint. (Doc. No. 21.) On August 30, 2023, 21 the pending motion was taken under submission on the papers.1 (Doc. No. 27.)
