Roark (“Plaintiff”) is a state prisoner incarcerated at California State Prison, Corcoran, proceeding pro se in this civil rights action filed pursuant to 42 U.S.C. § 1983 and 28 U.S.C. § 1331. (Doc. 1). This proceeding was referred to the Undersigned pursuant to 28 U.S.C. § 636(b)(1) and Local Rule 302.
