17 This matter is before the court on defendant’s motion to compel arbitration and to dismiss one of plaintiff’s claims. (Doc. No. 11.) On June 30, 2023, the pending motion was taken under submission on the papers pursuant to Local Rule 230(g). (Doc. No. 14.) For the reasons explained below, the court will grant in part and deny in part defendant’s motion to compel arbitration and deny defendant’s motion to dismiss.
