17 Plaintiff is proceeding pro se and in forma pauperis in this action filed pursuant to Bivens 18 v. Six Unknown Agents, 403 U.S. 388 (1971). 19 The instant action was filed on November 15, 2023. (ECF No. 1.) On December 28, 20 2023, Plaintiff filed a motion for a preliminary injunction. (ECF No. 8.) On January 2, 2024, 21 Findings and Recommendations were issued to deny Plaintiff’s motion for a preliminary 22 injunction. (ECF No. 9.) On January 25, 2024, Plaintiff filed objections to the Findings and 23 Recommendations and a separate notice of appeal.
