14 JENNIFER GARY, et al., 15 Defendants. 16 17 Plaintiff is a state inmate proceeding pro se with a civil right action pursuant to 42 U.S.C. 18 § 1983. Plaintiff claims that prison officials failed to take action following an assault on a non- 19 party correctional officer. Presently before the court is plaintiff’s motion to proceed in forma 20 pauperis (ECF No.11) and his second amended complaint (ECF No. 10) for screening. For the 21 reasons set forth below, the court will grant the motion to proceed in forma pauperis and 22 recommend the complaint be dismissed without leave to amend. 23 IN FORMA PAUPERS 24 Plaintiff has submitted a declaration that makes the showing required by 28 U.S.C. 25 § 1915(a).
